Interstate Child Custody Helping Families Like Yours

Grand Rapids Interstate Child Custody Attorneys

Helping Families Navigate Interstate Child Custody Orders Kent, Kalamazoo and surrounding Counties

Interstate child custody concerns are becoming increasingly more prevalent. We live in a mobile society, and as families separate, one or more family members will move to a different state. This can create some very complicated issues in determining which state the matter should proceed in and what laws should apply to the case. At the MI Family Law Center, our Grand Rapids interstate child custody lawyers are prepared to help you successfully navigate the complexities of having a family law case where multiple states (or even countries) are involved.

The Court’s jurisdiction over children and support in Interstate cases are governed by two separate uniform acts. The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), MCL 552.1101 et seq, provides the basis for determining which state’s court should resolve custody and parenting time disputes. It also governs the enforcement of other states’ custody and parenting time orders. The Uniform Interstate Family Support Act (UIFSA), MCL 552.1101 et seq, provides the basis for determining which state’s court should resolve child support disputes, spousal support conflicts, and paternity actions. It also governs the enforcement of other states’ support orders.

If the parent of your child is moving out of state and you have concerns about custody arrangements, we encourage you to discuss your situation with our experienced team as soon as possible. Call (616) 227-4470 or contact us online today. Se habla español.

The Uniform Interstate Family Support Act (UIFSA)

While the UCCJEA provides a framework for addressing jurisdictional issues in child custody and visitation cases, it's important to note that it does not cover matters of child support. These are specifically governed by the Uniform Interstate Family Support Act (UIFSA). The UIFSA, like the UCCJEA, aims to resolve jurisdictional complexities but focuses on the enforcement and modification of child support and spousal support orders across state lines. Our Grand Rapids interstate child custody lawyers are prepared to assist with matters of both the UCCJEA as well as the UIFSA.

UIFSA establishes clear guidelines on which state has the authority to set, enforce, or modify a support order. Under UIFSA, the state with "continuing, exclusive jurisdiction" over a support order is the one in which the original order was entered as long as one of the parties involved in the support case – either the custodial or non-custodial parent or the child – continues to reside there. This prevents multiple states from issuing conflicting support orders and ensures a streamlined approach to support enforcement even when families move across state boundaries.
