When Can Michigan Courts Make an Initial Custody Determination?

The primary factor considered is whether Michigan is the "home state" of the child, as outlined in the UCCJEA. This means that for Michigan courts to assume jurisdiction, the child must have lived in Michigan with a parent or a person acting as a parent for at least six consecutive months immediately before the commencement of the child custody proceeding (or since birth for children younger than six months). If the child no longer resides in Michigan, the state can still have jurisdiction if it was the child's home state within six months before the commencement of the proceeding and a parent or person acting as a parent continues to live in Michigan.
