When Do I Need to Establish Paternity in Michigan?

Paternity is presumed when a child is born to married parents. Paternity is also typically presumed if the parents were married at the time of the child’s conception. This legal presumption means that the husband is automatically considered the child’s legal father without the need for additional legal steps or paternity proof.

How Do I Establish Paternity Through the Michigan Court System?

In instances where either parent refuses to sign an Affidavit of Parentage, or if the affidavit is contested by someone claiming paternity, the Michigan court system offers a legal pathway to establish paternity. This process begins with the filing of a paternity lawsuit, often referred to as a paternity action, by either parent.

The court may order genetic DNA testing of the mother, child, and alleged father to ascertain paternity with a high degree of accuracy. DNA testing in paternity cases is typically non-invasive and often consists of the collection of saliva samples from the inner cheek of the parties involved. If the DNA test indicates a high probability of paternity, the court may declare legal paternity, thereby assigning rights and responsibilities to the father.
